Harbor Code of Conduct for Pet Owners, Pet Registration, and Pet Registration Fee

 

 

Status of Issue:  The "Harbor Code of Conduct" is on the agenda for the Wednesday, March 18 meeting of the CBJ Docks & Harbors Operations/Planning Committee.  The committee will meet at 5 pm in CBJ Room 224.  A new draft of the code of conduct was issued before noon on Tuesday, March 17.  The code of conduct is on the committee's consent agenda.  Unless there is public comment or board discussion of the new version of the code of conduct, the code of conduct will be sent to the full Docks & Harbors Board for adoption on Thursday March 26.

 

 

 

CBJ Docks & Harbors are concerned about anti-social and disharmonious conduct of some harbor patrons/customers/users.  To address this behavior issue, harbor staff has proposed a code of conduct for harbor patrons.   One part of the "Harbor Code of Conduct" is a code of conduct for pet owners, especially directed at persons living in the harbor with pets and dogs, in particular.   Included in the pet owners code of conduct was a registration  and fee requirement for dogs living aboard boats in the harbors.

 

Most Recent Proposal By CBJ Docks & Harbors Staff

The most recent proposal for a "Harbor Code of Conduct" was prepared for the March 18, 2015 meeting of the Operations/Planning Committee.  Click here to view proposal.    At the February 18 committee meeting, the committee decided to defer action on the "Harbor Code of Conduct" so that the proposals submitted by Grateful Dogs could be incorporated into the proposed code of conduct.   The latest proposal from D&H staff does not incorporate the proposal from Grateful Dogs.  The latest proposal is very similar to the D&H staff's original proposal.  Though the latest proposal warns of infractions and penalties under Animal Control and D&H ordinances, much of the prohibited conduct is not prohibited by CBJ ordinances.

GDOJ Response and Proposal

A GDOJ response to the March 16 version of the pet owners code of conduct is being developed.  Unfortunately there is not much time between the release of the latest version of the code of conduct and the operations committeee meeting on Wednesday, March 18.

 

Grateful Dogs of Juneau submitted written comments on a version of the "Harbor Code of Conduct" to Docks & Harbor staff on February 16.   Click here to see committee minutes for Feb. 16 regarding the code of conduct.  Click here to view GDOJ comments regarding the proposal.  The GDOJ comments were provided to the Operations/Planning Committee for its February 18 meeting.  At the committee meeting, George Utermohle testified on behalf of Grateful Dogs of Juneau to urge the Docks & Harbors Board to adopt a pet owner code of conduct that incorporated the suggestions and approach endorsed by GDOJ.

 

GDOJ recognizes the significant, beneficial role that a code of conduct can play in establishing best practices/standards of behavior that promote a respectful and harmonious social environment in the community.   GDOJ endorses a code of conduct for all dog owners who use of the CBJ harbors. 

 

GDOJ recommends two significant changes to the original Docks & Harbors approach to a pet owners code of conduct. 

First, the registration requirement for dogs should be removed from the code of conduct.  The registration requirement is a separate matter distinct from a code of conduct and not appropriate for inclusion in a code of conduct.   The registration requirement should be addressed as a separate regulatory matter.

 

Second, a code of conduct should be aspirational, not punitive or regulatory.  An aspirational code of conduct establishes a higher standard of conduct that encourages a greater degree of responsible dog ownership.   An aspirational code of conduct does not include punitive sanctions if the code is not followed.

 

GDOJ also recommended that the Pet Owner Code of Conduct apply to all users of the harbors, not only to live-aboards in the harbors.  Live-aboards should not bear a disproportionate responsibility for keeping the harbors clean, safe, secure, and livable.   All pet owners who use harbor facilities should be responsible pet owners.

(1)  All users of CBJ docks and harbors properties, including floats, docks, and municipal wharfs, fingers, moorings, boat launches, parking lots and the adjacent upland docks and harbors properties, will clean up after their pets when present on CBJ docks and harbor properties and on property adjoining CBJ docks and harbor properties;

 

(2)   All users of CBJ docks and harbor properties will keep their dogs on-leash when on CBJ floats, docks, municipal wharfs, fingers, and moorings;

 

(3)   All users of CBJ docks and harbor properties who are accompanied by pets will be respectful of other users who may be afraid of or uncomfortable with pets; 

 

(4)   Persons living with pets aboard boats in the harbor will not let their pets infringe on the rights of other users of CBJ docks and harbor properties;

 

(5)   Persons living with pets aboard boats in the harbor will inform the harbor master of the number, species, gender, and other identifying characteristics of the pets on board the boat so that harbor personnel are aware that pets are onboard the vessel in the event of an emergency or in the event that a pet is at-large on docks and harbor properties;

 

(6)   Persons living with pets aboard boats in the harbor are responsible for their pets’ safety, health, and quality of life.

Animal owners will also be required to ensure the following:

 

(1)  During registration, dog owners shall provide proof the animal is licensed in accordance with current CBJ regulations.  Unlicensed dogs shall not reside within the CBJ Docks & Harbors system at any time. 

 

(2)  Be leashed at all times when on Docks and Harbors property, floats, fingers and moorings. 

 

(3)  Clean up after your animal on docks, parking areas, and all adjacent CBJ Docks & Harbors properties.  Use of waste bags or other waste removal products are mandatory on all Docks & Harbors properties.

 

(4)  Ensure animals are properly confined on the vessel.

 

(5)  Persons living with pets aboard boats in the harbor are responsible for their pets’ safety, health and quality of life.

Upcoming Action on Proposals 

The next step of the process will be the March 18, 2015 meeting of the Operations/Planning Committee.   At that time the committee will consider that March 17 version of the Harbor Code of Conduct.    The code of conduct is on the committee's consent agenda.  Unless there is public comment or board discussion of the new version of the code of conduct, the code of conduct will be sent to the full Docks & Harbors Board for adoption at the board's Thursday March 26 meeting.

"Municipal wharfs" are Douglas Wharf, Juneau Fishermen's Terminal, Ferry Dock Wharf, Juneau Cold Storage Wharf, and the Alaska Steamship Wharf.  CBJ Ord. 85.05.010

 

"Boat harbor" does not include "downtown waterfront, including the ferry terminal and lightering docks."   CBJ Ord. 85.05.010
